Retaliation Against Employee in Violation of EEOC Regulations

Wednesday, December 3rd, 2008

Question From Bill:

I have been terminated from my job after filing a claim with the EEOC for racial discrimination.

Answer From Phil Silberman:

An employer may not fire, harass, or otherwise “retaliate” against an employee for filing a claim of discrimination with the EEOC against the employer. Retaliation occurs when an employer takes an adverse action against an individual for a protected action. In this case, Bill may be a covered individual and his filing a claim of discrimination with the EEOC may be a protected action. Bill’s termination may be an adverse action.
